​Offender in Jail

When will my friend/relative be classified?
All offenders sentenced to the Department of Corrections are reviewed for classification while housed in jail. If the offender meets the statutory requirements to be classified, he/she will be classified. if they do no meet the requirements, they will be maintained on the Controlled Intake waiting list pending admission to the appropriate Assessment Center.

Can they appeal their classification?
All offenders classified in jail have the right to appeal their classification. The appeal must be in writing and must be sent within 5 working days to the following:

When will my friend/relative be transferred to the Assessment Center?
Only offenders that do not qualify for classification in jail will be transferred to an Assessment Center for classification. The Department is experiencing population pressures and there could be a significant wait time for transfer. The Assessment Center schedule intake daily based on available bed space.

Can my friend/relative transfer to a different jail?
Transfers between jails fall under the jurisdiction of the jailers. You or your family/friend/relative should contact the jails to make your request.

Can they be reclassified?
Offenders classified in jail are reclassified any time there is a significant change; detainer lodged/released, additional sentence entered, disciplinary behavior. Offenders may request a reclassification every 90 days through the Class D Coordinator at their facility.

*Complaints regarding the conditions of a local jail or the medical/mental health treatment an offender is receiving at a local jail are handled by the Division of Local Facilities. They can be reached at (502) 564-7290. They have a staff of Jail Inspectors assigned to address your concerns.

When can my friend/relative be reclassified?
Offenders housed in KY DOC institutions are reclassified any time there is a significant event that will change their custody level; detainer lodged/released, additional sentence entered, disciplinary conviction. Offenders are also reclassified twice per year on a schedule based on the offender's last digit of their state ID number. An offender may also request one (1) special reclassification every 12 months.

Can they appeal their classification?
All offenders have the right to appeal their classification. An institutional inmate shall appeal their classification in writing to the Warden of their institution within 5 days of their classification hearing. If they are not satisfied with the Warden's response, they may appeal to the Classification Branch at the following address:

Can my friend/relative transfer to a different institution?
A minimum of 6 to 12 month placement at an institution is required before a transfer to another institution shall be considered. Many factors affect this, such as disciplinary behavior, program involvement and population needs.

All transfer requests must originate at the institutional level. The offender needs to make his/her request for transfer through their assigned caseworker.

There is an established chain of custody for institutions. Each offender has an assigned caseworker that will recommend programming and monitor classification. The offender is to be engaged as much as possible in the process.
